Understanding South Dakota Family Law
Family law is highly dependent on state law. South Dakota's definition of a "family member" includes former spouses, those in a significant romantic relationship, any couple with a child or expecting a child together, and any two people in a parent/child relationship.
Under South Dakota state law, courts will encourage joint custody, though the primary consideration is the best interests of the child. Additionally, South Carolina is part of the Uniform Child Custody Jurisdiction Act, an interstate accord that requires states to recognize child custody decisions that were ordered in other states.
